Different types of accident claim.

To succeed in a claim for compensation, the law requires you to prove that your accident was someone else's fault and that your injuries were caused as a result of the accident in question.

It is a popular misconception that claiming compensation is just a formality. These cases can be difficult and complex and defendant insurers will do everything to avoid paying compensation in any way they can. Even if they accept they have to pay something they will try and offer you as little as they possibly can. That is why you need specialist lawyers to help you prove your case and obtain the justice and compensation that the law entitles you to.

Below you will find some basic information on the various types of accident categories, about what might be involved and what you should  do next.

Road Accident

Every road user owes a duty of care to other road users not to drive their vehicle negligently. If you've been involved in an accident where another driver has breached their duty of care to you and that has resulted in you suffering injury, then you may be entitled to bring a claim against the other driver.

You might be a pedestrian, a cyclist, motor cyclist or another car driver.

If your accident looks like it wasn't your fault, we will look at all of the evidence, take statements from any witnesses, liaise with the police and the insurers to present your claim on the best available terms.

Slipping / Tripping Accidents

Occupiers of buildings or premises, local authorities or private enterprises, all owe duties of care to lawful visitors or users of their facilities.

If you have tripped over an uneven paving stone, a difference in levels, caught your foot in a pothole or something similar and sustained an injury, you may well be entitled to compensation.

If you've had an accident in a supermarket or other shop, slipped on produce left on the floor or tripped over goods that have been left about inconsiderately, suffering injuries as a result, we will help you determine if you could be entitled to compensation.

Whether your claim will be successful or not will depend on the specific facts so call us today and speak to one of our experienced solicitors on 0151 513 3333. Alternatively email us at rs@dfb-solicitors.co.uk or leave your details on our online web form and we'll call you right back.

Accidents at Work

The law lays down many rules to protect employees from accidents at work and compensate them where injuries occur. If you've suffered an injury in the course of your employment, you may well be entitled to claim compensation. Furthermore, your employer must not treat you badly simply because you make a claim against him.

If you've had an accident at work, it might have been due to:-

. Inadequate or unsuitable work equipment
. Dangerous working practices
. Exposure to dangerous materials
. An unsafe system of work
. Possible breaches of the Health & Safety legislation

Remember even if you have been injured at work there is no guarantee that your employer will pay you while absent. To see whether you can make a claim and recover these and other losses contact us today.

Victim of a criminal assault?

The Criminal Injuries Compensation Authority (CICA) is an organisation set up by the British Government to compensate the victims of violent crime. The criteria for eligibility for an award of compensation is complex and the CICA do not pay solicitors' costs.

We can help you establish whether it would be in your interests to have legal representation for a CICA claim or maybe just help you by giving you some free initial advice.

There are strict rules requiring that the incident is reported to the police without delay. If you have not already reported the incident to the police you must do so without delay. Also you must continue to co-operate with their enquiries and assist them in bringing the offender to justice.

Please note that as no legal costs are paid by the CICA even in successful cases we cannot act on our normal "no win no fee" / "no cost to you" terms. We can however still offer a no win no fee service but our charges have to deducted from any compensation awarded. Our normal fee is 25% so you still get to keep 75% of any award. Further details are available on request.

Other Accident Types

Accident and injury claims are often as diverse as the activities and pastimes in which people participate. If you've been injured in any manner and you think there's good cause to show that your injuries occurred as a result of someone else's fault, you could benefit from specialist guidance.

Sometimes accidents occur during leisure time. Using inappropriate or poorly maintained sports equipment can injure you; food poisoning can strike at restaurants or organised events. If you've been injured whilst on a package tour arranged by a tour operator in England & Wales, you may be entitled to compensation, even if your accident occurred abroad. These type of claims can be very difficult particularly if the accident occurred aboard. Even if we cannot deal with ourselves then we may still be able to help you and refer your case to a foreign lawyer.
